On January 1, 2024, Senate Bill 235, modeled in part after federal rules of discovery, comes into effect.
It mandates that litigants exchange documents and information early in the process unless a court orders otherwise. Parties will be expected to submit evidence without submitting interrogatories or requests for the production of documents first. The new law also raises the discovery sanctions under C.C.P. 2023.050 from $250 to $1,000 if a party does not respond in good faith to a request for production of documents, produces the documents within seven days before a motion on the matter, or fails to meet and confer. Under this code, at the court’s discretion, the court can order the attorney to report the sanction to the State Bar.
