Parenting Plans Update 2023: An Introduction to Where We Are
Tuesday, November 28, 2023 (12:15 PM - 1:15 PM) (PST)
Description
Part One of Two:
“Parenting Plans Update 2023,”
in a brown bag format.
This meeting will address the following issues:
1. What is the difference between “legal custody” and “physical custody”?
2. When does the Court “allocate” “tie-breaking authority” between the parents? How might that work?
3. What constitutes “paralysis” in a family law case in the context of joint legal and/or physical custody?
4. What are the implications of this “paralysis” for the child/ren involved?
5. At what point does the Court consider sole custody or allocating portions of the legal custody to one or the other parent? How does that work?
6. What are the unintended negative consequences of “allocating” versus delaying decisions about the child’s medical, psychological, and educational care?
7. What is “Child Inclusive Mediation”? Is this a potentially useful tool?
8. What to do about team sports? Birthday parties? Gender identity issues?
(Date for Part 2 will be in 2024 and has not been confirmed)
